1. Overview

Welcome to Tingora.

These Terms of Service (“Terms”) apply to your use of Tingora.com and to purchases made through our online store. The terms “Tingora”, “we”, “us”, and “our” refer to:

These Terms govern the contractual relationship between Tingora AB and you as a consumer when you purchase products through our online store, as well as your use of the website and related services.

These Terms apply to consumers in the countries to which Tingora currently offers and accepts orders and deliveries. Your purchase is also subject to any mandatory consumer protection laws applicable to you. Nothing in these Terms limits or excludes rights that cannot legally be limited or excluded.

Before placing an order, you should read these Terms together with our Privacy Policy, Return & Refund Policy, and Shipping Policy.

By placing an order through our online store, you confirm that you have read and accepted these Terms.

Our online store is hosted and powered by Shopify. Shopify provides the technical e-commerce platform used to operate the store. Tingora AB is the seller of the products offered through Tingora.com, and any contract for the purchase of products is entered into directly between you and Tingora AB.

2. Eligibility and Account Requirements

To place an order, you must have the legal capacity to enter into a purchase contract. If you are under the age of majority in your country of residence, the consent of a parent or legal guardian may be required under applicable law.

To use certain features, you may be required to provide information such as your name, email address, billing information, and shipping details. You agree that all information you provide is accurate, complete, and current.

You are responsible for safeguarding your account credentials and for all activity conducted under your account.

3. Product Information

We make reasonable efforts to display products as accurately as possible. However, colors, dimensions, or materials may appear differently depending on your device and screen settings.

Product descriptions, availability, and pricing may change at any time without notice. We reserve the right to discontinue products or limit quantities sold to any customer.

4. Orders and Acceptance

Placing an order constitutes an offer to purchase. We may decline an order for legitimate reasons, including product unavailability, payment authorization issues, suspected fraud, obvious pricing or product information errors, delivery restrictions, or where accepting the order would violate applicable law.

An order is considered accepted when Tingora sends you an order confirmation confirming acceptance of the order. If we are unable to accept your order, we will inform you and refund any payment already received.

You may cancel an order before the goods have been delivered in accordance with applicable consumer law. If you wish to cancel or modify an order, please contact us as soon as possible. Tingora may only claim compensation arising from a cancellation to the extent permitted by applicable law.

5. Pricing, Taxes, and Billing

Prices displayed to consumers include applicable VAT where required by law. Any applicable shipping charges, taxes, duties, or other charges payable to Tingora will be clearly disclosed before you complete your order.

You are responsible only for charges applicable to your order that have been disclosed in accordance with applicable law. Customs, import VAT, and similar charges for destinations outside the EU customs territory are addressed in our Shipping Policy.

6. Shipping and Delivery

Delivery times displayed on our website are estimates unless expressly stated to be guaranteed. Delays may occur due to circumstances outside our reasonable control. This does not affect your statutory rights in the event of delayed delivery.

Tingora AB remains responsible for the goods during transportation until the risk passes to you in accordance with applicable consumer law.

Unless another delivery time has been agreed, goods will be delivered without undue delay and no later than 30 days after the contract has been concluded, in accordance with applicable consumer law

7. Right of Withdrawal and Returns

Your right of withdrawal, return conditions, and refund procedures are governed by our Return & Refund Policy [LINK], which forms an integral part of these Terms.

Consumers generally have the right to withdraw from a distance purchase within 14 days without giving any reason, subject to the exceptions provided by applicable law.

Nothing in these Terms limits your statutory rights under applicable consumer protection law.

8. Intellectual Property Rights

All content within the Services, including text, graphics, images, logos, trademarks, videos, and design, is owned by Tingora AB or its licensors and is protected by applicable intellectual property laws.

You may use the Services only for personal, non-commercial purposes. You may not copy, reproduce, modify, distribute, or exploit any content without our prior written consent.

“Tingora” and associated logos are trademarks of Tingora AB. Shopify’s trademarks are the property of Shopify Inc.

9. Product Use and Safety

You agree to use all products purchased from Tingora in accordance with provided instructions and for their intended purpose.

We are not responsible for damage resulting solely from improper, unsafe, or unintended use of a product, to the extent permitted by applicable law. Nothing in this section limits any mandatory consumer rights or liability that cannot legally be excluded or limited.

10. Optional Tools and Third-Party Services

We may provide access to third-party tools, services, or websites that are operated independently from Tingora. Such services may be subject to the third party's own terms and policies. Tingora is not responsible for third-party content or services to the extent permitted by applicable law. Nothing in this section limits Tingora's responsibilities that cannot legally be excluded.

11. Relationship to Shopify

The Services are hosted and powered by Shopify. All purchases and transactions are made directly between you and Tingora AB.

Shopify provides the technical platform used to operate our online store. The contract for the purchase of products is concluded solely between you and Tingora AB.

12. Privacy

Your submission of personal data is governed by our Privacy Policy [LINK].

Because the Services operate on Shopify, Shopify may process certain personal data in accordance with its own privacy practices.

13. Feedback and User Submissions

Any reviews, comments, suggestions, or other submissions you provide grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and publish such content.

You confirm that you own or have the right to submit the content and that it does not violate any third-party rights.

14. Errors, Inaccuracies, and Omissions

We reserve the right to correct obvious errors, inaccuracies, or omissions. If an obvious pricing or product information error affects an order, we will contact you and handle the matter in accordance with applicable consumer law.

15. Prohibited Uses

You may not use the Services:

  • For unlawful purposes

  • To violate applicable laws or regulations

  • To infringe intellectual property rights

  • To harass, abuse, or harm others

  • To submit false or misleading information

  • To upload malicious code

Violation may result in suspension or termination of access.

16. Force Majeure

Tingora is not responsible for delays or failures caused by circumstances beyond our reasonable control to the extent permitted by applicable law, including natural disasters, strikes, serious transportation disruptions, or similar events.

Nothing in this section limits your statutory rights, including any rights relating to delayed or failed delivery, cancellation, termination, or refunds.

17. Statutory Consumer Rights

Products sold by Tingora AB are subject to the mandatory consumer protection laws applicable to your purchase. Nothing in these Terms excludes or limits your statutory rights relating to defective goods, non-conforming goods, delayed delivery, withdrawal, refunds, remedies, or damages.

18. Limitation of Liability

Tingora AB is liable in accordance with applicable mandatory consumer protection law. Nothing in these Terms limits any liability or consumer remedy that cannot legally be limited or excluded.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.

20. Entire Agreement

These Terms, together with referenced policies, constitute the entire agreement between you and Tingora AB regarding the Services.

21. Assignment

We may transfer our rights and obligations under these Terms to another company where permitted by law, provided that such transfer does not reduce your rights under the agreement or applicable consumer law.

22. Governing Law and Disputes

These Terms are governed by Swedish law. However, if you are a consumer residing in another country, this choice of law does not deprive you of any mandatory consumer protection afforded to you under the laws that would otherwise apply to your purchase.

If you have a complaint, please contact Tingora first so that we can attempt to resolve the matter.

Consumers in Sweden may, where the applicable requirements are met, refer a dispute to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden – ARN), Box 174, 101 23 Stockholm, Sweden, www.arn.se.

You may also have the right to bring a dispute before a competent court or other competent dispute resolution body under applicable law.

23. Changes to the Terms

We may update these Terms from time to time. The Terms applicable to your purchase are the Terms in effect at the time your order is placed, unless otherwise required by law.
